Complete Rules for Wonders of Life Photo Contest

Please read additional Contest rules and the Terms and Conditions of Participation before submitting your photo:

Eligibility

To enter LIFE ’s Wonders of Life Photo Contest (the “Contest”), you must be 18 years of age or older and live in the United States. Board Members and Employees of the LIFE Foundation (“LIFE”) and their families are not eligible.

What to Enter

The entry should capture a wondrous moment in the life of your family – one that conveys true peace, joy and meaning. Photo descriptions of 50 words or less MUST accompany all submissions to be considered.

Participants in the Wonders of Life Photo Contest are limited to one photo entry only.

You are responsible for obtaining, on behalf of LIFE, the written permission of all individuals in the photograph permitting LIFE to use their image and likeness, and if requested, you are responsible for providing such written permissions to LIFE.

The photograph should accurately reflect the subject matter and the scene as it appeared. Photos that have been digitally altered beyond standard optimization (removal of dust, cropping, reasonable adjustments to exposure, color and contrast, etc.) will be disqualified. Multiple exposures that have been combined to produce a single “High Dynamic Range” image are acceptable. Images that do not meet these requirements may or may not be judged at the judging panel’s discretion.

Entries must be digital files in the highest resolution possible. Previously published material for which non-exclusive rights were granted may be entered as long as you still permit LIFE to license the photograph (as described below). You must be able to disclose when and where the photo appeared previously to LIFE upon request.

Your Rights

You will retain all rights to the photograph you submit—including ownership if applicable—other than those rights licensed in the next sentence. By entering the contest, you hereby grant to LIFE (i) a nonexclusive, worldwide, irrevocable, royalty-free license to reproduce, distribute, publicly display and publicly perform the photograph you submit to the Contest in all media now known or developed in the future, and (ii) the right to use your name, city, state and country of residence in promotions and other publications, both print and online.

All photographs will be credited with the caption “© Year. Person’s Name”. LIFE has final approval of any language that appears on its website with any of the photos and will not promote or endorse third-party products or services.

How to Enter

Your photo entry must be submitted using Flickr™. Use your Yahoo!® ID to login to www.flickr.com. If you do not have an account, you can sign-up for free at www.flickr.com. Flickr™ and Yahoo!® are trademarks of Yahoo, Inc. See step-by-step instructions, including a video tutorial, at www.lifehappens.org/photocontest. If you have trouble using Flickr™, please consult its online help files. The LIFE Foundation is not responsible for any issues or problems you encounter while trying to upload a photo on Flickr™.

LIFE will accept entries at www.wondersoflife.org beginning at 12:00 a.m. Eastern Daylight Time on September 1, 2009 through the month of September, ending at 11:59 p.m. Eastern Daylight Time on September 30, 2009.

LIFE reserves the right to adjust any deadline(s) as the result of causes beyond its immediate control.

Judging

The winning photos will be chosen by a judging panel consisting of a professional photographer, and several members of LIFE’s Board of Directors and staff. The judging panel will select one Grand Prize winner and five Runners-up. Winners will be announced on or about December 10, 2009.

Entries will be judged on how well they depict a moment of true peace, joy and meaning in the life of a family or individual. Originality, technical excellence, composition, overall impact and artistic merit will also be considered in the selection of the winners.

LIFE shall determine winner eligibility in its sole and absolute discretion. All decisions made by the judges are final.

Prizes

The Grand Prize will be a Canon T1i, 12.2-Megapixel Digital SLR Camera, which has a retail value of approximately $800. The Grand Prize winner will be given the option to instead receive an $800 gift card to be used for a purchase of any item of his or her choice at Bestbuy.com. Five Runners-up will also be chosen, with each receiving a $150 gift card to Bestbuy.com.

By entering, participants agree to indemnify, defend and hold harmless the LIFE Foundation (“LIFE”), its respective subsidiaries, affiliates, directors, officers, employees, attorneys, agents and representatives, from any and all third-party liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the competition (collectively, “Losses”), including, without limitation, any third-party claim for copyright infringement or a violation of an individual’s right to privacy and/or publicity right. The Contest is void where prohibited by law.

Each participant in the Contest (each a “Participant”) is responsible for ensuring that he or she has the right to submit his or her photograph to the Contest per these rules (see additional “Compliance Alert” below).

The Grand Prize winner must provide his or her name, address, and Social Security number to LIFE, and is responsible for payment of all income taxes due on account of his or her receipt of a prize.

You agree that any and all disputes that cannot be resolved with LIFE, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, before a court of competent jurisdiction located in Arlington, Virginia, which court shall apply the laws of the Commonwealth of Virginia without regard for rules of conflicts of law. IN ANY SUCH DISPUTE, PARTICIPANT SHALL NOT BE ENTITLED TO ANY PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES, OR ANY DAMAGES OTHER THAN PARTICIPANT’S ACTUAL OUT-OF-POCKET EXPENSES (IF ANY) ASSOCIATED WITH PARTICIPATING IN THE CONTEST. YOU HEREBY WAIVE ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED. The Contest and LIFE’s website are provided “as is” without warranty of any kind, either expressed or implied.

LIFE is not responsible for any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in the photo competition, or by any technical or human error that may occur in the processing of submissions to the photo competition, including but not limited to any misprints or typographical errors. LIFE assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. LIFE is not responsible for any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer on-line systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant’s or to any other person’s computer related to or resulting from participating or uploading images or information in the photo contest.

If, for any reason, the photo competition is not capable of completion as planned, including, but not limited to, any reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of LIFE that corrupt or affect the administration, security, fairness, integrity or proper conduct of the photo competition, LIFE reserves the right at its sole discretion to cancel, terminate, modify or suspend the photo competition.

LIFE is also not responsible for any questionable or inappropriate material that is uploaded to Flickr’s Wonders of Life Group. LIFE staff will do its best to remove said material as quickly as possible.

COMPLIANCE ALERT: If you are a licensed insurance agent, be advised that the insurance companies you do business with may not permit its sales representatives to use Flickr™ for business-related purposes. Before entering the Wonders of Life Photo Contest or encouraging clients and prospective clients to enter, please check with the companies with which you do business to find out if policies exist that prohibit your participation in promotions of this nature.
